They will be able to assist in the compilation of relevant evidence and any other violations Child Protective Services could have committed. For Truitt and her family, this safety plan had devastating effects. As part of the plan, Truitt was asked to place her son in the care of a family member. No- On the other hand, denying a CPS caseworker entry into your home may cause them to believe you are being overly difficult and could count that against you. The other thing to consider is that CPS can get permission to enter your home from a judge’s Order or simply by asserting that an exigent circumstance necessitates their entry. I add this statement because I stand by it as the number one thing I wish people would consider. They are highly trained and educated people, but they are still just people. They aren’t doing anything as personal vendetta against you and they aren’t judging you in a personal way. CPS is there to help, whether it be getting a child out of a dangerous situation or helping a parent gain skills or resources. The goal of any investigator is not to harm your family, but to improve it.
When we become parents, we do NOT sign away our rights to privacy and due process. CPS workers are notoriously over worked, under paid, under trained, and poorly educated in regards to a professional career. Say as little as possible and get an attorney fast. I have a neighbor who in my opinion, is a horrible parent.
However, getting angry and refusing to answer questions will only make the situation worse. In fact, workers are given the right by law to interview you. Refusing could mean they take your kids away right away, rather than using the information you and your child give to assess the situation. Although their separation was relatively short, Truitt says her family is still suffering the effects. Her son, who will be three in August, constantly screams to be held, which she says is a new behavior.

You may also benefit from recording the situation on your own record recorder or cell phone. Although CPS can show up to your home without notice, they cannot enter without your consent. Unless CPS has a court order, or they believe your child is in immediate danger, they can’t enter your home unless you say it’s okay. Parents should still know their rights during a CPS visit. There’s a lot that CPS can and cannot do during a home visit.
